A license issued without an examination, for up to 180 days and extendable once, to keep an agency running when the agent behind it dies, is disabled, or is called up. Nobody applies for it on their own behalf in the ordinary case: the four openings in the statute are all about somebody else's business.

    No state exam for this license

    • A licensed insurance agent or an insurer whom the Commissioner may require as a suitable sponsor, and who assumes responsibility for all acts of the temporary licensee

    K.S.A. 40-4907(a) issues it "without requiring the applicant to pass a written examination" and lists who may receive one: the surviving spouse or court-appointed personal representative of an agent who dies or becomes disabled, to allow time to sell the business or train new staff; a member or employee of a licensed business entity on the death or disability of the individual named in its license; the designee of an agent entering active service in the armed forces; and, as a catch-all, anybody at all where the Commissioner deems the public interest best served. A license issued to a surviving spouse lapses the moment one is issued to a court-appointed personal representative, and no temporary license survives the disposal of the business. The extension in (c)(1) is one further period of up to 180 days, except for the armed forces designee, whose license may be renewed for as long as the Commissioner thinks the business needs it.
