The Kansas Public Adjuster license

Acts for the insured, for a fee, on a first party claim for loss or damage to real or personal property. K.S.A. 40-5502(l) writes "covered by and limited to commercial lines insurance contracts" into all three limbs of the definition, so a Kansas public adjuster may not take a householder's claim at all: of the 39 public adjuster licenses on this site, counting the files whose slug is exactly public-adjuster or public-insurance-adjuster and leaving out the trainees, solicitors, apprentices, emergency variants and Connecticut's property public adjuster, which would make it forty-five, no other one is confined to commercial policies. It is the only adjuster-family license Kansas issues.

Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license held in another state, moving here already licensed or a license already held.

  1. Route 1 Pass the public adjuster examination

    Financial responsibility

    • a surety bond in favor of the Commissioner, or an irrevocable letter of credit from a qualified financial institution, in whatever amount the Commissioner requires, running for as long as the license does

    and an office the public can reach

    • An office maintained in the home state with public access during regular business hours or by reasonable appointment

    K.S.A. 40-5505 is the closed list of what the Commissioner must find, and there is no course anywhere in it: home state eligibility, no ground for denial, trustworthy and reliable and of good reputation, financial responsibility under 40-5511, an application fee not to exceed $100, and an office in the home state with public access during regular business hours or by reasonable appointment. Subsection (b) adds two more, being at least 18 and having passed the examination. The paper is KS Public Adjuster, code 12-KS-17, 90 minutes, $57, and K.A.R. 40-7-26 sets it at 70 percent and says what it covers: Kansas statutes, the Department's regulations, the duties and responsibilities of a public adjuster, and basic insurance. The retake ladder in 40-5506(c) is unlike the agent's: seven days after a first failure, seven after a second, six months after a third, and after two years the applicant is treated as new and the ladder starts again.

  2. Route 2 Hold a public adjuster license in another state

    Exempt from the state exam

    • a current public adjuster license in another state, obtained by passing that state's public adjuster examination

    K.S.A. 40-5507(a). The condition is how the other license was got rather than what it says: the applicant must be "currently licensed as a public adjuster in another state based on the individual's passage of a public adjuster examination". A license issued somewhere on a waiver does not open this door. This is the resident route; 40-5508 issues a separate nonresident license and conditions it on the home state awarding nonresident licenses to Kansans on the same basis.

  3. Route 3 Move to Kansas and apply within 90 days

    Exempt from the state exam

    • 90 days Licensed as a public adjuster in another state on that state's examination, and applying to become a Kansas resident licensee within 90 days of establishing legal residence.

    K.S.A. 40-5507(b). Kansas puts the 90 days on the applicant as a duty rather than as an opportunity, in the same drafting style as 40-4908(b) for agents: somebody licensed elsewhere who moves here "shall make application within 90 days of establishing legal residence". No pre-licensing examination is required of that individual.

  4. Route 4 Return to a cancelled Kansas license within twelve months

    Exempt from the state exam

    • a Kansas public adjuster license cancelled not more than twelve months before the new application, with the applicant in good standing at cancellation

    K.S.A. 40-5507(c). Twelve months from cancellation and good standing at the moment of cancellation. The agent license's equivalent, 40-4908(a)(3), runs for two years and asks for a VOLUNTARY surrender; this one asks only that the license was cancelled and the holder was in good standing, which is the wider of the two.

Nobody sells preparation for the Kansas public adjuster paper. Three adjuster products cover Kansas and none of them is for this license: Kaplan's Certified All-Lines Adjuster course is the Florida designation this site has declined in three other states on the strength of Kaplan's own page naming the sixteen states it makes sense in, Mometrix's Insurance Claims Adjuster Course is a national product whose page does not mention Kansas, and ExamFX lists a Kansas Adjusters training whose checkout failed at the package step on two separate checks, so it has no price to publish. All three are for adjusters who work for insurers, and Kansas does not license one.
