A prepaid legal or dental service plan, registered rather than licensed, and registered together with the people who sell its memberships: the application carries a list of every individual who solicits on the plan's behalf, and every continuation reports who has joined that list and who has left it.

    K.S.A. 40-4209(a)(1) asks for three things and no more: the completed application form, a list of each individual who solicits memberships on the plan's behalf, and a filing fee capped at $100. Subsection (b) is the whole test for issuing it and it is drafted as a duty with an exception, which is the same shape as the agent waiver section: the certificate "shall be issued to or continued for a prepaid service plan by the commissioner of insurance unless the commissioner of insurance, after due notice and hearing, determines that the prepaid service plan is not competent, trustworthy, financially responsible or of good personal and business reputation". Continuation runs in annual periods on a fee capped at $50 with an update to the list of solicitors. The security sits in a different section: 40-4211 asks for a deposit of securities with the Commissioner, or a surety bond or irrevocable letter of credit in its place, to guarantee performance.
