Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license already held, a license held in another state or moving here already licensed.

  1. Route 1 Pass the examination

    State exam required

    K.S.A. 40-4905(b) is the closed list of what the commissioner must determine before approving a resident application: at least 18 years old, no act that is grounds for denial, a nonrefundable fee capped at $30, and the examination passed for each line of authority applied for. No course is in it, and the fee cap is in the statute rather than in a schedule. Kansas calls the licensee an insurance agent rather than a producer, which is worth knowing before searching for the form. This line carries a door that closed a long time ago. K.S.A. 40-4908(a)(4) waives the examination for an applicant for a license to write insurance on growing crops who has been continuously licensed to write that coverage in Kansas on and after April 30, 1986. Nobody new can reach it, and it is here because it is one of the five waivers the section lists. Missouri has the same shape on its Property line with a 1995 date, and Alabama's is 2013.

  2. Route 2 Have voluntarily surrendered a Kansas license for this class within two years

    Exempt from the state exam

    • a Kansas insurance agent license for the Crop class, voluntarily surrendered not more than two years before the application, with the educational requirements satisfied for the current licensing period

    K.S.A. 40-4908, and note how it is drafted: the Producer Licensing Model Act writes these exemptions as a list of people no examination is required of, and Kansas writes the same exemptions as a duty on the regulator, "the commissioner shall waive examinations for". Subsection (a)(3) is the one most likely to apply to somebody coming back: the applicant held a Kansas license for the class being applied for, VOLUNTARILY SURRENDERED it not more than two years before the application, has satisfied the educational requirements for the current licensing period, and the commissioner is satisfied they are trustworthy and competent. A license that lapsed rather than being surrendered, or that was taken away, is not this route.

  3. Route 3 Hold the same line in another state

    Exempt from the state exam

    • an insurance agent or producer license carrying the Crop line of authority in another state

    K.S.A. 40-4908, and note how it is drafted: the Producer Licensing Model Act writes these exemptions as a list of people no examination is required of, and Kansas writes the same exemptions as a duty on the regulator, "the commissioner shall waive examinations for". Subsection (a)(1) covers somebody previously licensed for the same lines of authority in another state, while that license is current or if the application arrives within 90 days of its cancellation with good standing certified by the other state or shown in the NAIC producer database.

  4. Route 4 Move to Kansas and apply within 90 days

    Exempt from the state exam

    • 90 days Licensed as an insurance agent in another state carrying the Crop line of authority there, and applying to become a Kansas resident licensee within 90 days of establishing legal residence.

Subsection (b) covers moving here: somebody licensed as an agent in another state who moves to Kansas shall apply to become a resident licensee within 90 days of establishing legal residence, and no person previously authorized for any line of authority shall be examined here for the same line except as the commissioner requires by rule and regulation.
