The Kansas Home State Administrator license

Home State Administrator

Collects premiums or charges, or adjusts or settles claims, for somebody else's insurance business, from a base in Kansas. It is an entity license and its bar is financial rather than educational: audited accounts showing a positive net worth, biographical affidavits for everybody who runs the applicant, and a business plan showing enough experienced staff to do the work.

  1. Route 1 Apply with audited accounts and a business plan

    No state exam for this license

    • a surety bond for the greater of 10 percent of the funds handled for Kansas residents or $20,000 where unaudited financial statements are filed, and, for anybody administering governmental or church self-insured plans, a bond for the greater of $100,000 or 10 percent of the self-funded coverage handled in Kansas and every other state

    K.S.A. 40-3812(b) is the whole list and no part of it is a course or an examination: the organizational documents, the bylaws, NAIC biographical affidavits for the board and the principal officers and anybody holding 10 percent or more of the voting interest, audited annual financial reports for the two most recent years showing a positive net worth, a business plan detailing staffing for claims processing, record keeping and underwriting, an application fee not to exceed $400, and whatever else the Commissioner asks for. The hardship route in (b)(5) lets an applicant file unaudited statements instead and buys that with a bond. The license has no term: 40-3812(f) keeps it valid "for so long as the administrator continues in business in this state and remains in compliance".

Nothing here is taught. Kansas asks a third party administrator for audited accounts, biographical affidavits and a staffing plan, and gives no examination for it, so there is nothing to sell.
