The instrument for somebody who does an administrator's work for a self-funded plan and is not required to hold the administrator license: they register with the Commissioner every year instead. It carries real weight elsewhere in the Code, because a pharmacy benefits manager holding one is outside the pharmacy benefits manager licensure act altogether.

    K.S.A. 40-3810 reaches a person who is not required to be licensed as an administrator and who underwrites, collects charges or premiums from, or adjusts or settles claims on Kansas residents only in connection with life, annuity or health cover provided by a self-funded plan other than a governmental or church plan. That person "shall register with the commissioner annually, verifying its status as herein described". Three people are outside it: an insurer, an individual doing the work as an employee of an insurer, and a person doing it under contract to or as an employee of an administrator. Note what the section itself never says. It calls this registering and nothing more, and two other provisions call the result a certificate: K.S.A. 40-3821(d) takes a pharmacy benefits manager "that holds a certificate of registration as an administrator pursuant to K.S.A. 40-3810" outside the whole licensure act, and K.A.R. 40-1-41(a)(2) exempts the same holders from the managing general agent regulation. The document exists; the section that creates it does not name it.
