Employment by or association with a preneed seller, named on the application, on whose behalf the agent sells, negotiates or solicits
Iowa Code 523A.502. The Division asks for three things and no course among them: an application through NIPR LicenseHub, a ten dollar fee, and a criminal history background check for every legal name the applicant has used. The seller is not a detail on the form, it is the license's condition: an applicant cannot submit an application without identifying the preneed seller they will sell for, and the Division states that the license is not effective at any time during which the agent is not employed by or associated with one. What puts this in scope is the hundred and twenty days: a sales agent is somebody authorized to advertise, sell, promote or furnish cemetery merchandise, funeral merchandise or funeral services where performance or delivery may fall more than a hundred and twenty days after the initial payment, which is what makes it a prearranged sale the Insurance Division regulates rather than a shop transaction.
