    Section 10-15-103(1)(a), C.R.S. stops a contract seller entering a preneed contract or accepting any money without a license from the commissioner, and asks for a written, signed and verified application on the Division's form, $500, and proof of the net worth or surety bond the commissioner sets by rule. Section 10-15-103(1)(b) adds fingerprints from every applicant, and defines applicant to include each officer and director of a corporation; they go to the Colorado Bureau of Investigation for a state and national record check, and an arrest with no disposition on the result triggers a name-based judicial record check on top. Section 10-15-103(2) then makes the license mandatory rather than discretionary: on a complete application and fee the commissioner shall issue it unless the applicant made false statements, does not meet the conditions, or is not authorized to transact business in Colorado. The Division's own instruction sheet fills in the rule: a balance sheet, income statement and cash flow schedule signed by an accountant evidencing a net worth of at least $100,000, or in the alternative a $100,000 bond for preneed contract obligations issued by a Colorado-licensed insurer. It also asks for a certificate of good standing from the Secretary of State, every contract form including trust-funded and insurance-funded versions with the specimen policy and assignment, the negotiated trust agreement, every general provider agreement, a plan of operations and biographical affidavits. No examination and no course. The license expires on June 30 and is renewed annually with an annual report.

Nothing is sold for it and nothing could be. Article 15 sets no examination and no course for a preneed contract seller: what it tests is the applicant's net worth or bond, its fingerprints and its contract forms.
