The Colorado Pharmacy Benefit Manager license

Section 10-16-122.1(2.5)(a), C.R.S., inside a section whose own short title is the Pharmacy Fairness Act, stops a person establishing or operating as a pharmacy benefit manager in Colorado from 2024 unless registered with the commissioner, and says in terms that the requirement reaches all pharmacy benefit managers doing business in the state, including one not directly connected with a carrier. Section 10-16-122.1(2.5)(b)(I) leaves the form, the manner and the application and renewal fees to the commissioner's rules, and directs that the fees be set at amounts commensurate with the registration fees other states charge, so the figure is benchmarked rather than set. No course and no examination. Section 10-16-122.1(2.5)(b)(II) lets the commissioner deny, suspend, revoke or refuse to renew a registration, or issue a cease-and-desist order, after notice and a hearing, for a material misstatement in the application among other grounds. The list of pharmacy benefit managers a carrier contracts with goes to the commissioner separately under 10-16-122.1(2)(a), with the carrier's rate filing, and 10-16-122.1(2)(b) makes that list confidential and not subject to the open records act.
