    The club's recommendation and appointment

    • Recommendation and appointment by an authorized automobile club or association, under Rule 48 Section 7(a)(3)

    and experience, education or training

    • Sufficient experience, education or training as to the kinds of insurance and other motor club services defined in Ark. Code Ann. 23-77-101(2) which the applicant will be selling, under Rule 48 Section 7(a)(5), with no period, syllabus or hour count set anywhere

    Rule 48 Section 6 is the requirement: "before any agent or representative shall solicit or sell memberships in an automobile club or association transacting business in this State, he or she shall obtain a license from the Insurance Commissioner". Section 7 is the qualifying list and there are five things in it, of which four are age, residency, the club's appointment and a finding of competence and good character. The fifth is the only thing taught and it carries no figure: sufficient experience, education or training as to what will be sold. A salaried officer or employee whose duties are primarily administrative or clerical and who takes no commission is outside the definition of agent and needs no license. Rule 31 sets no syllabus for this line and the examination vendor gives no automobile club paper.

The qualification is experience, education or training the Commissioner judges sufficient for the particular products the applicant will sell, with no hours, no syllabus and no approved course to be one of; the register has no automobile club group and the examination vendor gives no paper. No national seller offers an Arkansas product for it.
