AS 21.96.110(b) is the licensing sentence and it covers all three at once: a viatical settlement provider, representative or broker applies to the director, submits what the director requires, and pays the fee, and nobody may act as one without the license. The section fixes no examination, no course and no experience bar for any of the three. AS 21.96.110(f)(5) hands the qualification standards to regulation and no such regulation has been adopted: 3 AAC 23 covers fingerprinting, examination scores and continuing education and says nothing about viatical settlements, which is the same shape as Delaware’s unused delegation at 18 Del. C. 1751(b) and Massachusetts’s at 162L(a)(3). Alaska also puts a second regulator in the frame: AS 21.96.110(a) gives the director the transactions between viators and providers, and gives the commissioner the viatical settlement investments under AS 45.56, the state securities act. AS 21.96.110(h)(5) defines the representative as a person who is an authorized agent of a viatical settlement provider or broker and who acts or aids in any manner in the transaction of a viatical settlement contract, excluding an attorney, an accountant, somebody exercising a power of attorney granted by the viator, and anybody retained and paid to represent the viator. This is the tier other states leave unlicensed: Delaware, Iowa, Virginia, New York and Texas license a provider and a broker between them and stop. Alaska licenses the agent underneath as well, at the same $100 as the broker. The fee is $100 under 3 AAC 31.025, initial or biennial renewal, resident or non-resident.

No national seller sells a course for this license. There is nothing to prepare for: Alaska sets no examination, no course and no experience requirement for any of its three viatical settlement licenses, and the standards the statute delegates to regulation have never been adopted.
