Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination or a license held in another state.

  1. Route 1 Pass the examination

    State exam required

    • A bond in an amount acceptable to the director requiring the managing general agent to conduct business under title 21, and an errors and omissions insurance policy acceptable to the director, either of which the director may require

    AS 21.27.590 adds nothing to the general qualifications except two discretions, a bond and an errors and omissions policy, and it is worth reading the verb: the director "may require" them rather than shall. AS 21.27.020(b) is the closed list of six general qualifications behind every individual license in the chapter and no course is in it: eighteen or older; a bona fide resident actually residing in the state, for a resident license; the examination under AS 21.27.060 passed; trustworthy; not using the license principally to write controlled business; and no act that is a ground for denial anywhere. AS 21.27.020(f) lets the director add education or experience requirements by regulation, and the regulations adopted under it, 3 AAC 23, are continuing education from end to end. What the license is for sits in AS 21.27.610: a managing general agent has only the authority the appointing admitted insurer confers, and may exercise the powers this title gives insurance producers and independent adjusters, but only for the kinds of insurance and within the scope that insurer authorized. So the license is real and its content is written by somebody else’s appointment. AS 21.27.850(1) is the consequence worth knowing: a managing general agent may act as an adjuster on behalf of an insurer that has appointed it, incidental to acting as a producer, without an independent adjuster license.

  2. Route 2 Hold the license in your home state

    Exempt from the state exam

    • a current license of the same type in the applicant’s home state, in good standing, where that state licenses Alaska residents on the same basis

    AS 21.27.270(b) is one reciprocity provision covering seven license types at once, the producer, limited lines, surplus lines broker, managing general agent, reinsurance intermediary broker, independent adjuster and reinsurance intermediary manager. It asks for three things: a current home state license in good standing, the fees, and either the application filed at home or a completed uniform application. The third condition is the one that can close the route without anything changing here, because it is about the other state: the home state has to award Alaska residents the same license on the same basis. AS 21.27.270(a) then goes further than most states dare, letting the director waive any license application requirement in the chapter by order to reach reciprocity under the Gramm-Leach-Bliley Act. AS 21.27.270(e) is the price of a non-resident license: an irrevocable power of attorney appointing the director to receive service of process, which stays irrevocable for as long as a cause of action could arise.
