Every way to qualify

More than one route leads to this license, and which one you take changes what you study and whether you sit the exam. There is no pre-licensing course among them: this license is qualified for by sitting the examination, a license held in another state, moving here already licensed or a license already held.

  1. Route 1 Pass the examination

    State exam required

    Ala. Code 27-7-4.3(a) asks a written examination of a resident producer applicant unless the applicant is exempt under 27-7-5 or 27-7-29.1, and 27-7-5(a) is the closed list of what the commissioner must find before approving the application: 18 years old, no act that is a ground for denial, the examination passed for the lines applied for, and the fees paid. It is introduced with "all of the following" and no course is in it. So the examination is the whole of the qualification here, and the zero is read off a complete statutory enumeration rather than off a department page. Fail it twice and the wait is three months; fail twice more and it is six. Bail bond is line of authority (8) at Ala. Code 27-7-14.1(a) and it is not inside the definition of limited lines insurance at 27-7-1(13), which is what 27-7-5(a)(3)a excuses from the examination. So the general requirement at 27-7-4.3(a) reaches it. That definition ends in a clause letting the commissioner deem other lines limited, so this reading is of the list as published rather than of a closed set.

  2. Route 2 Hold the same line in another state

    Exempt from the state exam

    • an insurance producer license carrying the Bail Bond line of authority in another state

    Ala. Code 27-7-29.1(a). It waives the prelicensing education and the examination together, which in Alabama means the examination, there being no education to waive. The other license has to be current, or else the application has to arrive within 90 days of its cancellation with either a certification of good standing from that state or a good standing record for the same line in the NAIC producer database.

  3. Route 3 Move to Alabama and apply within 90 days

    Exempt from the state exam

    • 90 days Licensed as an insurance producer in another state carrying the Bail Bond line of authority there, and applying to become an Alabama resident licensee within 90 days of establishing legal residence in Alabama.

    Ala. Code 27-7-29.1(b). The 90 days run from the day legal residence in Alabama is established, the exemption reaches only a line the other state had already granted, and the commissioner may narrow it by regulation. Alabama writes this one as a duty rather than an option: a producer licensed elsewhere who moves here "shall, within 90 days of establishing legal residence, make application".

  4. Route 4 Have held the line in Alabama since before 2013

    Exempt from the state exam

    • an Alabama producer license carrying the Bail Bond line of authority, held lawfully immediately before January 1, 2013 and never out of effect for 12 consecutive months since

    Ala. Code 27-7-5(a)(3)c. A producer lawfully licensed for this line immediately before 2013-01-01 never has to sit its examination, and the exemption survives until the license is allowed to lapse for 12 consecutive months, at which point it is gone for good. It is a closing door rather than a route anybody new can take, and it is here because it is one of the four exemptions the statute lists.
